Please review the following Terms and Policies (hereinafter referred to as the "Terms"). Your use of, and purchase from, www.montelvacoffee.com and Montelva Coffee (hereinafter referred to as the "Site" and the "Seller," respectively) are subject to these Terms. By purchasing a product from the Seller, you are subject to the Terms.

THESE TERMS INCLUDE A DISPUTE RESOLUTION CLAUSE REQUIRING BINDING ARBITRATION. ARBITRATION PROVIDES FEWER DISCOVERY AND APPELLATE REVIEW OPTIONS THAN MAY BE AVAILABLE IN COURT, AND YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL. PLEASE REVIEW THE ARBITRATION CLAUSE BELOW CAREFULLY AND IN ITS ENTIRETY.

Your Consent

You must be at least 18 years old and be able to consent to the Terms. If you are under the age of 18, or you do not agree with the Terms as stated herein, please stop now and do not purchase from the Seller. By purchasing, you agree to the Terms as stated herein, regardless of whether or not you have read the Terms.

Disclaimer

This Site and anything purchased from the Site and/or the Seller are provided on an "as is" basis and without warranties of any kind, either express or implied, to the extent permitted by law.

The Site and the Seller disclaim implied warranties of merchantability and fitness for a particular purpose.

The Site and the Seller do not warrant that your use of the Site will be error-free.

Although the Seller does its best to provide helpful, accurate, and complete information, it does not warrant, guarantee, or make any representation regarding the accuracy or reliability of information available on the Site.

Your use and/or purchase of products from the Site and/or Seller are at your own risk. To the fullest extent permitted by law, the Site and Seller are not liable to you or any other person or entity for any indirect, consequential, punitive, special, or similar loss, damage, injury, lawsuit, or harm experienced as a result of products purchased from the Site and/or Seller.

Merchandise Information

Product availability is not guaranteed, and merchandise may become unavailable or sell out. We make reasonable efforts to display product images, colors, packaging, sizes, roast levels, grind options, ingredients, and descriptions accurately. Actual appearance, packaging, color, or presentation may vary from what appears on the Site, including when suppliers or packaging are updated.

Coffee and tea are consumable products. Customers are responsible for reviewing product descriptions and available ingredient or allergen information before purchasing or consuming a product and for contacting us with any questions before placing an order.

Prices

Prices are subject to change without notice. We reserve the right to modify, change, or alter our prices at any time. We are not liable to you for any price change.

Transactions

The Site and Seller reserve the right to refuse or cancel any order, including an order affected by a pricing, product, inventory, payment, or technical error, at any time.

We reserve the right to limit the number of items you can purchase.

We reserve the right to prohibit the purchase of items for unauthorized resale or distribution.

By purchasing from the Site and/or Seller, you warrant and represent that you have the right to use the payment method, account, and/or credit card used to purchase the items.

Return and Refund Policy

At Montelva Coffee, we want you to feel confident trying our coffee. If for any reason you are not satisfied with your first bag of coffee, we will gladly provide a full refund on your first purchase - no return necessary.

Because coffee is a perishable product, returns are generally not accepted after the first order unless there is an issue such as damage during delivery.

If your order arrives damaged, please contact us at info@montelvacoffee.com within 48 hours of delivery so we can help resolve the issue. Please include your order number and photographs showing the damage. Unfortunately, we are unable to process replacement requests or claims reported after 48 hours.

Damage and Shipping Issues

If tracking shows that an order was delivered but you have not received it, please notify us in writing at info@montelvacoffee.com within 48 hours of the recorded delivery. You must also contact the carrier responsible for delivering the order to report and help resolve the issue. We are not responsible for a carrier's failure to deliver an order, but we will provide available shipment information to assist with a carrier claim.

Customers are responsible for providing a complete and accurate shipping address. Additional shipping costs caused by an incorrect or incomplete address may be the customer's responsibility.

Cancellation Policy

Orders cannot be canceled once they are placed. Montelva Coffee products are roasted, prepared, and fulfilled specifically for each customer after an order is submitted. Please carefully review your products, quantities, grind selections, shipping address, and payment information before completing checkout.

Subscription changes and cancellations are governed by the Purchase Options Cancellation Policy displayed at checkout and on the Site.

Shipping Policy

Because our coffee is roasted fresh after your order is placed, orders typically require 1-5 business days for processing before shipment.

Once shipped, delivery typically takes an additional 1-5 business days, depending on the destination and carrier. Delivery times are estimates and may be affected by carrier delays or other circumstances outside our control.

We currently offer free shipping on all U.S. orders.

We ship throughout the United States and offer international shipping to select locations where available at checkout. International customers are responsible for any applicable customs duties, taxes, or import fees.

Once your order ships, tracking information will automatically be sent to the email address used at checkout.

No Claims Made Regarding Results

The Site and the Seller do not guarantee, warrant, or imply that you will achieve a particular result, cure, positive outcome, or experience as a result of using or purchasing our products.

Intellectual Property

The Site and/or the Seller own or lawfully use the intellectual property rights associated with the Site and the design, names, branding, content, and creation of products offered by the Seller. You are not authorized to copy, reproduce, resell, or distribute the Seller's proprietary materials or branded products except as permitted by law or with prior written authorization. Arbitration Clause

If you have any complaint or if any issue arises from use of the Site or the Seller's products, please contact us directly first by emailing info@montelvacoffee.com.

If we are unable to resolve the dispute amicably, you agree that you and the Seller shall submit the dispute to binding arbitration with the American Arbitration Association before a mutually agreed-upon arbitrator and in accordance with the American Arbitration Association's rules.

By agreeing to this clause, you acknowledge that you are waiving your right to a jury trial in court, which would otherwise be available if not for this Arbitration Clause. Any arbitration hearing shall be held within 50 miles of Mesa, Arizona, unless the parties agree otherwise.

If the arbitrator issues an award and a judgment is entered, the judgment will be binding and may be entered in a court in the State of Arizona. To the fullest extent permitted by law, the only monetary award that may be issued to you is a refund of the payment made to Montelva Coffee for the applicable product. You may not seek additional consequential, special, or punitive damages.

Consent to Governing Law

The Terms and any dispute arising out of them shall be governed by the laws of the State of Arizona, without regard to conflict-of-law principles.

Consent to Jurisdiction

You irrevocably consent to the exclusive jurisdiction and venue of the United States District Court for the District of Arizona or a state court located in Arizona in connection with any matter arising out of the Terms and/or your purchase from the Site and/or the Seller that is not required to be resolved through arbitration.

Consent to Service

You irrevocably agree that legal process may be served on you in any manner authorized by the laws of the State of Arizona, and you waive any objection you might otherwise have to service of process under Arizona law.

Defense and Indemnification

You shall, at all times, indemnify, defend, and hold harmless the Site, the Seller, and all of our shareholders, officers, members, affiliates, contractors, subcontractors, directors, assignees, employees, and licensees from and against all losses, damages, injuries, delays, deaths, lost profits, and expenses arising out of any proceeding (a) brought by either a third party or by the Site and/or the Seller; (b) arising out of your breach of your obligations, representations, warranties, or covenants under the Terms; or (c) arising out of any alleged breach or negligence said to have been committed by you.

Termination of Your Use

At our sole discretion, we may terminate or restrict your use of or access to the Site and/or products if you abuse, violate, or breach any of the Terms.

Entire Agreement

The Terms constitute the entire agreement between you, the Site, and/or the Seller with respect to the Site and/or products, and they supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and us with respect to the Site and the products.

Severability

The provisions of the Terms are severable, and the invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision. If any paragraph, section, subsection, sentence, or clause of the Terms is rendered illegal, invalid, or unenforceable, that illegality, invalidity, or unenforceability shall have no effect on the Terms as a whole or on any other paragraph, section, subsection, sentence, or clause.
